Since this date I have looked into my account further and discovered a further Â£30 charge on 02.10.2006. <br /><br />On 30.07.2007 you wrote to me promising to send me a full response within 8 weeks and update me with progress. I received a delayed response from you on 02.10.07, stating that you will inevitably keep me updated on the position, but since then you have failed to do so. I have attached a schedule of charges which I expect back.                 <description><![CDATA[ O/DRAFT EXCESS FEE<br />UNPAID D/D <br />UNPAID S/O  <br /><br /><br /><br />Dear Sir/Madam<br /><br /><br /><br />Due to recent media coverage on bank charges I now believe that you, Lloyds TSB Bank Plc, have been charging me charges that are contrary to the Unfair Terms in Consumer Contracts Regulations 1999. Schedule 2 (e) of the said regulations gives a non-compete list of terms, which may be regarded as unfair, such as a term that requires me as a consumer who fails in his obligation, to pay a disproportionately high sum in compensation. <br /><br />I believe that your charges are disproportionately high and therefore they arte contrary to the Unfair Terms in Consumer Regulations 1999. In addition I believe that your charges are a Penalty, Penalty charges are irrecoverable at common law. The precedent for this was Dunlop Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd [1915] AC 79 along with Murray v. Leisure play [2005] EWCA Civ 963. It was held that a contractual party can only recover damages for an actual loss or liquidated losses. It is clear that your charges do not reflect any actual and or real loss.<br /><br /> ]]></description>

                <description><![CDATA[ In 2005, following graduation from secondary school, I had a strong desire to prepare myself for the challenging tasks life presented. I earned a place on a law course in Estonia that would both challenge and stimulate me. I felt however, that that I should be certain of my future career path before committing to years of study in a very specific area. I decided that I needed to gain a wider knowledge of the world before I chose the direction, which I wanted to follow.   I decided to follow my desire to experience new cultures and lifestyle and despite the wariness of leaving  territory of all that was familiar to me, I decided to take a gap year. This change has also provided me with the confidence to achieve the goals that I have now set for myself.  I feel that early experiences within a business environment coupled with my own ambition and thirst for knowledge has given me the unique  perspective which couples innate ambition with real life experience.<br />
<br />
I initially became interested in the business world whilst helping my family run a large bakery business in Estonia. Throughout my youth, I  realised that business was a fast paced and interesting world that would both excite and push me to achieve success. The opportunity I was given as a young person pushed me to work hard and taught me to take responsibility not only for myself but as part of a team.<br />
<br />
My passion for business increased when as my first role in Edinburgh, I worked as an assistant manager in Threshers. I realised that business was not limited to one specific area, increasing my desire to learn and and experience in the field of business. My experience helped me to develop an understanding of the potential opportunities a business degree would offer. Whilst working in a variety of managerial roles I learned how to prioritise tasks, make decisions and meet targets. <br />
 <br />
I am currently employed as a Retention Consultant at Scottish Widows. The opportunity to work in one of the most recognized business and financial establishments, which deals with assurances, investments and pensions has given me yet another unique insight into the world of business. The knowledge of the products I deal with on a daily basis has provided me with in-depth business skills. I relish the opportunity that a degree would give me to further my knowledge in this area. I believe this course would provide me with the knowledge required to succeed at a higher level in my chosen field. If I was accepted at university, I plan to stay in part-time employment with Scottish Widows as it would undoubtedly be beneficial as preparation for a business career. <br />
<br />
At present, I am also using my current knowledge within this field, to identify a profitable niche within the current on-line boom.  I have used as a base to develop an on-line retail business on e-bay. I have been importing clothing and footwear from Asia in bulk for the last eight months and reselling the product with great success. I  have used my current level of expertise to develop and expand this business and in the process have learnt a great deal about profit margins, the benefits of buying in bulk as well as the importance of customer satisfaction leading to the reputation as a &#039<img src="http://e.deviantart.com/emoticons/w/winkrazz.gif" width="15" height="15" alt=";p" title="Wink/Razz" />ower seller' on the site. <br />
<br />
I will always have a desire to travel and broaden my awareness of cultures; as I believe that understanding of your key demographic is an important aspect of successful business.   A degree in business would give me an unlimited access to most parts of the world. I have a huge passion for languages, as demonstrated by my three existant languages.  I feel that this degree would give me the opportunity to use my knowledge and enrich my social skills and competencies in terms of a business career. I believe that the combination of language skills and business knowledge is vital in order to be successful  in this ever increasing global economy.. I currently speak Estonian, Russian, English and also understand Ukrainian. I aim to learn Spanish this year as I am planning to go traveling to South America from April 2008 till the end of July 2008. <br />

In conclusion, I feel that my combination of solid business experience, my desire to acquire knowledge, evidenced by my linguistic ability and work background have given me a solid base upon which to develop my skills within this area.
