                <description><![CDATA[ It has been TWICE now in LESS THAN HALF A MONTH that I've come close to death/serious injury.<br /><br />The first time, earlier this month, was pneumonia. I nearly died because I couldn't breathe. I'm better now.<br /><br /><br />Then, tonight, I got into an accident. My scooter hit a slick spot on the road in the middle of a rain storm at 40mph. I went over and slid a good 30 ft or so. Unhurt, due to wearing ridiculously heavy clothes(czech military issue pants and a 1950's era italian army jacket, both are heavy canvas) and a helmet, but my scooter's trashed and I'll have to fix it tomorrow.<br /><br /><br /><br /><br />...yes, I ride a motorscooter. If you laugh, I'll kill you while reminding you cheerfully that I get 100mpg on it and filling the tank costs only 2$ and lasts me forever.<br /><br /> ]]></description>

Martin and McConnell. They join Montana, Utah, and Texas in an effort to limit federal regulation of guns, and specifically invoke the 9th and 10th Amendments as restrictions on federal power:<br /><br />Âthe regulation of intrastate commerce is vested in the states under the ninth and tenth amendments to the United States Constitution, particularly if not expressly preempted by federal law. Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunitionÂ<br /><br />Read the full text of the legislation below:<br /><br />A BILL TO AMEND CHAPTER 31, TITLE 23 OF THE 1976 CODE, RELATING TO FIREARMS, BY ADDING ARTICLE 9, THE ÂSOUTH CAROLINA FIREARMS FREEDOM ACTÂ, TO PROVIDE THAT A FIREARM, FIREARM ACCESSORY, OR AMMUNITION MANUFACTURED AND RETAINED IN SOUTH CAROLINA IS EXEMPT FROM FEDERAL REGULATION UNDER THE COMMERCE CLAUSE OF THE CONSTITUTION OF THE UNITED STATES.<br /><br />Whereas, the tenth amendment to the United States Constitution guarantees and reserves for the states all powers not granted to the federal government in the Constitution; and<br /><br />Whereas, the ninth amendment to the United States Constitution guarantees to the people rights not granted in the Constitution and reserves to the people of South Carolina certain rights. The guaranty of those rights is a matter of contract between the state and people of South Carolina and the United States; and<br /><br />Whereas, the regulation of intrastate commerce is vested in the states under the ninth and tenth amendments to the United States Constitution, particularly if not expressly preempted by federal law. This constitutional protection is unchanged from the 1895 South Carolina Constitution, which was approved by Congress and the people of South Carolina, and the right exists as it was understood at the time that the compact with the United States was agreed upon and adopted by South Carolina and the United States in 1895. Now, therefore,<br /><br />Be it enacted by the General Assembly of the State of South Carolina:<br /><br />SECTION 1. Chapter 31, Title 23 of the 1976 Code is amended by adding:<br /><br />ÂArticle 9<br /><br />South Carolina Firearms Freedom Act<br /><br />Section 23-31-700. This article may be cited as the ÂSouth Carolina Firearms Freedom ActÂ.<br /><br />Section 23-31-705. It's a biathlon out in the desert in Texas that comes every August. I hope to compete this year. It's a six mile circuit consisting of four or more shooting stages(ranges from 200-300 yards), with naught but open desert between them. It's actually quite grueling, as most entrants don't finish.<br /><br />Currently, I'm training for it by getting used to carrying large quantities of water with me while I walk long distances(miles). After I've got that down, I'm also going to load another bag of similar style up with weights to replicate walking around with 100 + rounds of ammo. My goal is to be able to handle the competition with relative ease. Once that's done, I can get to work on honing my shooting. This canard does not comport, however, with criminological research in the U.S. or elsewhere.<br /><br />An extensive study that one of us (Keats) recently published with Canadian criminologist Gary Mauser confirms the negative results of two large-scale international studies over the past 15 years. ("Would Banning Firearms Reduce Murder and Suicide: A Review of International Evidence," Harvard Journal of Law & Public Policy, vol. 30, pages 651-694.)<br /><br />These studies compared data from a large number of nations around the world. There were no instances of nations with high gun ownership having higher murder rates than nations with low gun ownership. If anything it was the reverse, for reasons discussed below.<br /><br />For example, though Norway has far and away the highest firearm ownership per ca pita in Western Europe, it nevertheless has the lowest murder rate. Other nations with high firearms ownership and comparably low murder rates include Denmark, Greece, Switzerland, Germany and Austria. Holland has a 50 percent higher murder rate despite having the lowest rate of firearm ownership in Europe. And Luxembourg, despite its total handgun ban, has a murder rate that is nine times higher than countries such as Norway and Austria.<br /><br />It turns out that in nations where guns are less available, criminals manage to get them anyway. After decades of ever-stricter gun controls, England banned handguns and confiscated them from all permit holders in 1997. Yet by 2000, England had the industrialized world's highest violent crime rate -- twice that of the U.S. Despite the confiscation of law-abiding Englishman's handguns, a 2002 report of England's National Crime Intelligence Service lamented that while "Britain has some of the strictest gun laws in the world, [i]t appears that anyone who wishes to obtain a firearm [illegally] will have little difficulty in doing so."<br /><br />In the rare case in which gun bans work, murderers use other weapons. Eight decades of police-state enforcement of handgun prohibition have kept Russian gun ownership low, resulting in few gun murders. Yet Russia's murder rates have long been four times higher than those in the U.S. and 20 times higher than rates in countries such as Norway. Former Soviet nations like Lithuania also ban handguns and severely restrict other guns, yet have 10-15 times higher murder rates than European nations with much higher gun ownership.<br /><br />Nor does the "more guns means more murder" belief square with our own experience. The earliest American figures, dating from just after World War II, showed both gun ownership and murder rates holding at low levels. Today our murder rates are almost identical, despite six decades of massive gun buying whereby Americans have come to own five times more guns than they did in 1946. The intervening years saw a dramatic increase in murder followed by a dramatic decrease. These trends had no relationship to gun ownership, which steadily rose all the while (especially handgun ownership).<br /><br />American demographic data also refute the myth that fewer guns in a community mean less murder. The murder rate among African-Americans is six times higher than among whites. Does this mean African-Americans have more guns? No, ordinary law abiding African-Americans are markedly less likely than whites to own guns. But the argument for banning guns to everyone is refuted, since fewer guns for law abiding African-Americans does not mean fewer guns for African-American criminals. Incidentally, rural African-Americans own guns as frequently as whites, but the murder rate among them is only a tiny fraction of the urban African-American rate.<br /><br />Regardless of race, the distinction between good people and criminals is vital. It is utterly false that most murderers are ordinary people who went wrong because they had guns. Almost all murderers have life histories of violence, restraining orders, substance abuse problems and/or a form of psychopathology. It's generally illegal for these people to have guns, but unlike good people, they ignore gun laws -- just as they ignore laws against violence.<br /><br />The "more guns means more murders" mythology also flies in the face of history. From the 1600s, American colonial law required that every household have a gun and that every military-age male be armed for militia service. They are, after all, "just words."<br /><br />He certainly loves parts of America. San Francisco. Chicago. New York. D.C. University towns and union enclaves. Where left wing ideologies and identity politics hold sway, you'll find a part of America that Obama likes and understands.<br /><br />The rest of the nation may as well be another world for the freshman Senator, as remote to him as the Indonesian schools of his youth are to the rest of us.<br /><br />He doesn't seem to understand that the America outside of his comfort zone doesn't associate the sincerity or depth of love with this nation with fealty to the political party in charge at the time. He's used to seeing feckless American liberals threaten to leave the country if a Republican wins an electionÂthough regrettably, few of these fickle souls live up to their wordÂand associates that as a normal behavior. Instead of "My country, right or wrong," his life story is a tale replete with a string of associates and mentors that boldly proclaim "my country, my way, or God damn you all."<br /><br />Speeches are nice, and he certainly plays a teleprompter as lyrically as a human being can.<br /><br />But Barack Obama has lived his life in the counterculture of America. He counts among his greatest influences a communist poet, a lynching advocate priest, a crackpot conspiracy-mongering reverend, and the detritus remnants of the last great experiment in American self-loathing.<br /><br />The majority of Americans have been raised with a nearly instinctual love of this nation that is not tied to who resides at 1600 Pennsylvania Avenue, and that doesn't associate pride or shame in their nation of birth solely on the policies and actions of elected officials that will blow away on an electoral wind.<br /><br />The freshman Senator from Illinois is surprisingly insulated from the American experience, even as he claims to credit America for his success. He claims to believe in the America, but every policy he outlines, every dream he frames, is nailed to an ever-engorging government. A program for this. A policy for that. Restrictions here, entitlements all around, and a tax on both your houses to pay for it all.<br /><br />Barack Obama is in love with the possibilities of American government. Rod Blagojevich guilty of 16 of 24 counts in his Illinois corruption trial.<br /><br />Antoin "Tony" Rezko was accused of scheming to get bribes from businesses seeking state contracts.<br /><br />The jury delivered its verdict Wednesday after a nine-week trial.<br /><br />Rezko has known Obama since he entered politics and was involved in a 2005 real estate deal with the Democratic presidential candidate, although testimony barely touched on their relationship. I don't even think we'll be able to find a place, given that we can't afford much in this town. Given that my mother absolutely refuses to leave this area for a house(no idea why, she just does), I'm betting on the latter. We can't even afford the costs of moving.<br /><br />You probably don't know the reason we have moved so much. I can sum it up in a few words. Kicked out, couldn't pay rent.<br /><br /><br />I bet I sound rather down about this. I'm not so much down as outright pissed off. Too much shit too soon.<br /><br />On top of that, I'm getting strung along on the computer thing. I'm also pissed about that. I just wish my family could be honest for once. Broken. Fucked.<br /><br />The BIOS isn't recognizing that there's even a hard drive in it, and since it's a laptop, I can't just swap it out with a new one. <br /><br />I was browsing a site, and all of a sudden it just locked up. I go to restart and it doesn't detect my HD.<br /><br />It wasn't a virus(Linux is immune to them), just an old comp giving up the ghost.<br /><br />I lost a ton of stuff. I think around 12GB of music, all of my story I was writing, all the books I had on there, all my homeschooling data(from after the Feburary backup), and a ton of other stuff.<br /><br />I'm writing this on my ancient backup computer(it sure is a trusty little thing <img src="http://e.deviantart.com/emoticons/s/smile.gif" width="15" height="15" alt=":)" title=":) (Smile)" />).<br /><br />I won't be online for a while, due to my lack of solid computing hardware. At 25(the distance I zeroed it at), I can get a five shot group about the size of a silver dollar. Not good, but a lot better than before.<br /><br />I only had 120 rounds to burn, but I noticed no problems with my scope once I got it zeroed. The mount is still solid. I'll have to get more ammo to see if it will stay solid.<br /><br /><br />I wasn't able to get a camera in time, so there are no pics. Heller, the first case in more than 60 years in which the court will confront the meaning of the Second Amendment to the U.S. Constitution. Although Heller is about the constitutionality of the D.C. handgun ban, the court's decision will have an impact far beyond the District ("Promises breached," Op-Ed, Thursday).<br /><br />The court must decide in Heller whether the Second Amendment secures a right for individuals to keep and bear arms or merely grants states the power to arm their militias, the National Guard. This latter view is called the "collective rights" theory.<br /><br />A collective rights decision by the court would violate the contract by which Montana entered into statehood, called the Compact With the United States and archived at Article I of the Montana Constitution. When Montana and the United States entered into this bilateral contract in 1889, the U.S. approved the right to bear arms in the Montana Constitution, guaranteeing the right of "any person" to bear arms, clearly an individual right.<br /><br />There was no assertion in 1889 that the Second Amendment was susceptible to a collective rights interpretation, and the parties to the contract understood the Second Amendment to be consistent with the declared Montana constitutional right of "any person" to bear arms.<br /><br />As a bedrock principle of law, a contract must be honored so as to give effect to the intent of the contracting parties. A collective rights decision by the court in Heller would invoke an era of unilaterally revisable contracts by violating the statehood contract between the United States and Montana, and many other states<br /><br />Numerous Montana lawmakers have concurred in a resolution raising this contract-violation issue. The Democrats are riding high with two groundbreaking candidates Â a woman and an African-American Â while the conservative Republicans are in a quandary about their partyÂs nod to a quasi-liberal maverick, John McCain.<br /><br />Each candidate is carefully pandering to a smorgasbord of special-interest groups, ranging from gay, lesbian and transgender people to children of illegal immigrants to working mothers to evangelical Christians.<br /><br />There is one group no one has recognized, and it is the group that will decide the election: the Angry White Man. The Angry White Man comes from all economic backgrounds, from dirt-poor to filthy rich. He represents all geographic areas in America, from urban sophisticate to rural redneck, deep South to mountain West, left Coast to Eastern Seaboard.<br /><br />His common traits are that he isnÂt looking for anything from anyone Â just the promise to be able to make his own way on a level playing field. In many cases, he is an independent businessman and employs several people. He pays more than his share of taxes and works hard.<br /><br />The victimhood syndrome buzzwords Â Âdisenfranchised,Â ÂmarginalizedÂ and ÂvoicelessÂ Â donÂt resonate with him. &#147<img src="http://e.deviantart.com/emoticons/w/winkrazz.gif" width="15" height="15" alt=";P" title="Wink/Razz" />ress ÂoneÂ for EnglishÂ is a curse-word to him. HeÂs used to picking up the tab, whether itÂs the company Christmas party, three sets of braces, three college educations or a beautiful wedding.<br /><br />He believes the Constitution is to be interpreted literally, not as a Âliving documentÂ open to the whims and vagaries of a panel of judges who have never worked an honest day in their lives.<br /><br />The Angry White Man owns firearms, and heÂs willing to pick up a gun to defend his home and his country. He is willing to lay down his life to defend the freedom and safety of others, and the thought of killing someone who needs killing really doesnÂt bother him.<br /><br />The Angry White Man is not a metrosexual, a homosexual or a victim. Nobody like him drowned in Hurricane Katrina Â he got his people together and got the hell out, then went back in to rescue those too helpless and stupid to help themselves, often as a police officer, a National Guard soldier or a volunteer firefighter.<br /><br />His last name and religion donÂt matter. His background might be Italian, English, Polish, German, Slavic, Irish, or Russian, and he might have Cherokee, Mexican, or Puerto Rican mixed in, but he considers himself a white American.<br /><br />HeÂs a manÂs man, the kind of guy who likes to play poker, watch football, hunt white-tailed deer, call turkeys, play golf, spend a few bucks at a strip club once in a blue moon, change his own oil and build things. He coaches baseball, soccer and football teams and doesnÂt ask for a penny. HeÂs the kind of guy who can put an addition on his house with a couple of friends, drill an oil well, weld a new bumper for his truck, design a factory and publish books. He can fill a train with 100,000 tons of coal and get it to the power plant on time so that you keep the lights on and never know what it took to flip that light switch.<br /><br />Women either love him or hate him, but they know heÂs a man, not a dishrag. If theyÂre looking for someone to walk all over, theyÂve got the wrong guy. He stands up straight, opens doors for women and says ÂYes, sirÂ and ÂNo, maÂam.Â<br /><br />He might be a Republican and he might be a Democrat; he might be a Libertarian or a Green.
