Well, actually it wasn't so miraculous. I am now officialy the poorest person on the planet...BUT I have a shiny new Canon 20D and I'm ready to go! My first digital photo on DA is "Stage Fright."

Anyways, I now have 1000+ deviations to go through which means...I won't. If there's anything you've done in the last 6 months that you'd like me to see, drop me a link, and I will go check it out. This is about the most basic application of "fair use" I can imagine. So I fired off a letter back to them, and have yet to receive a response.


Recently, my photo manipulation "Tony and George" (in which I showed two side-by-side images of President Bush and British Prime Minister Tony Blair—one unmodified, and one in which they appear to be a couple: holding hands, looking in each other's eyes, etc) was removed from DeviantArt cititing copyright violations.

I believe that this is in error because my rights to use this image are clearly protected under the "fair use" title of the US Federal code.

Title 17, Chapter 1, § 107 states "Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work...for purposes such as criticism, comment, news reporting, teaching...is not an infringement of copyright."

Precedent shows that satire falls squarely within the "comment" designation of the code. In fact, the use of media photographs (of which this is an example) in just such a manner by shows such as "The Daily Show" and others is protected under the "fair use" title.

Accordingly, I would like to point out that DeviantArt is in no way in violation of copyright law by displaying this work, and that its removal may well represent political bias both on the part of the complainant and the administrator who removed it. As a result, I respectfully request that DeviantArt respect my rights to fair use, and that I be allowed to post this work.

Over the 4th of July weekend I went up to Westport, Connecticut to visit my Grandfather. In the process I took five roles of film, and should have at least a couple good pictures. I've got one up already and I'm working on more.

Charlie Stokes a.k.a ~ryutora (incidentally, it's also her birthday. Go say hi.)

About the Artist:
One of my earliest watchers, I came across her site because of our shared interest in science and scfi-themed pieces. (At one time or another, we both tried our hands at making a galaxy in photoshop).

Having just turned 14, ~ryutora ranks in among the younger members of DevArt, but any inclination to patronize her is squashed flat in seconds by a razor-sharp mind directing an ever-exploring creative spirit. She is what I can only describe as brutally innovative with her own creative style. She choses a medium and a style, and goes about improving her abilities in that particular area. I have gotten the impression that as soon as she feels comfortable in that particular area, she immediately chooses a different medium and style. It is truly a joy to watch her daily progression, each piece builds on the experiences of the last, each noticably more fluent in her new language.

Why She Won:
If the description above isn't enough. Since we met (if such a word can be used in the context of the internet), she has taken the time to comment on virtually all of my new pieces. On several occasions, she has written a lengthy paragraph response. Although a lacking a little in the constructive criticism category, this one has been a long time in coming.

I just got home from the first performance of Harvey, in which I'm playing Elwood P. Dowd, and the stage makeup looks rediculous close up.

There I talked to a guy named Jason who explained Mike's mistake (which I had suspected from the beginning: he told me to save it to a disk in a compressed file format). Jason seemed at the same time knowedgable and personable, and we struck up a conversation. Reprinted here for your entertainment (extensive paraphrasing employed due to bad memory):

Ari: Well, it certainly is a relief to talk to someone who knows how to use Photoshop.

Jason: I know what you mean. I work as a digital colorist for [some company].

Ari: Oh, that's cool. I've never been good at recoloring myself, although one of my friends is. [~gavinsartwork]

Jason: Yeah, how do you do it? Adjustment layers or painting color on the image...?

Ari: Usually I just go in for basic stuff, adjustment layers and such. If that doesn't work, I often just abandon the picture.

Jason: Yeah, well... one thing I'm just starting to get into is the digital painting scene. I'm not very good at it, but some of the stuff other people can do will just blow you away.
