                <description><![CDATA[ Silly case and stupid arguments... all  this would never make a start of any  kind of trial if applied to any normal  people, from any normal prosecutor...  but insanity, hate and money are the  keys here.<br />

[b]One little example: the reason why  the accusing family cant seem to  remember hard dates of this alleged  threatening, kidnapping and molestation  is because Jacksons people kept them  away from clocks and dates. They  claim there were no calendars or clocks  anywhere at Neverland. How convenient  for them.especially considering that  Jackson has a huge-ass clock built into  the landscape of his Neverland ranch!  Not to mention one can get a cheap  watch from Wal-mart for under $7.00.  What? They werent kidnapped and taken  to Wal-mart? Just expensive stores and  hotels? <br />
<br />
Not to mention the fact that there are  3rd -party witnesses who were at  Jacksons Neverland ranch during the  prosecutions timeline who saw this  family there, conversing with people  and walking around Neverland like  everything was just fine. Two of those  witnesses are reporters by the way. I  guess it didnt cross their minds to  ask any one of them for the date or  time? Yeah right. [/b]<br />

<b>Prosecutors are claiming that Jackson  conspired to kidnap, then kidnapped a  family of 4after already knowing them  for yearsand holding them at the  wide-open Neverland Ranch. Then, they  claim Jackson molested the accuser.  Then they claim he conspired some more.</b><br />

And this was supposedly all done right  in the middle of at least 2 independent  investigations into these very  allegations. Not to mention the medias  white-hot spotlight being focused on  this kid and this family, the family  being caught on tape numerous times  talking about what a wonderful person  Jackson is, and signing sworn  affidavits in connection with these  independent investigations sparked by  so-called concerned citizens.<br />

Citizens -- and potential jury pool  members -- in Santa Barbara,  California, are scratching their heads  over Fridays 11th hour raid on pop  star Michael Jacksons ranch, and "CJ"  has discovered the search may signal a  division in the ranks of his  molestation cases prosecution.<br />

"CJ" talked to Santa Barbara florist  Maurice Sourmany, who says he was in  the Junior Chamber of Commerce with  District Attorney Tom Sneddon. "I dont  want to judge Tom Sneddon because hes  a personal friend of mine," Sourmany  told us. "But by the same token, people  are starting to talk."<br />
<br />
Sourmany said he wonders why his old  buddy waited until such a late date to  put a cotton swab in Michael Jacksons  mouth to get a DNA sample from the  superstar. "Why now? Why so late in the  game?" Sourmany asked. "These are  things I thought he should have done a  long time ago."<br />
<br />
Meanwhile, in a rare moment, Jackson  prosecutor Gerald Franklin spoke to us  outside the DAs office. While he  stressed that the gag order prevented  him from discussing details, sources  are privately pointing to a possible  rift within the DAs office, with one  faction saying they are ready for a  January 31st trial, while others insist  the last-minute raid shows they need to  buy more time to get the case ready.<br />
<br />
We also spoke with defense attorney  Robert Sanger, who was similarly mum,  but sources tell us that the defense  might not ask for a delay -- precisely  because they sense the DA might not be  ready, even as both sides hit the  Monday deadline to turn over discovery  to the other side.<br />
<br />
"What will be, will be," Franklin said  to us, regarding discovery. "I dont  have any expectations. I imagine there  will be the odd document."<br />
<br />
In terms of strategy, the defense is  now reportedly expected to attack  Jacksons accusers mother. Published  reports say the defense will likely  question that the mother appropriately  used money raised at The Laugh Factory  in 2000 by comedians like Chris Tucker  and George Lopez; the funds were  earmarked for the accusers medical  expenses since the boy had cancer at  the time. A source close to the Los  Angeles comedy club told us he thinks  the money went to the accuser's father,  but the dad's attorney scoffed at that  claim, saying he's never heard of any  money from any fundraiser going to his  client.<br />

                <description><![CDATA[ Lawyers for superstar Michael Jackson  are preparing to attack the credibility  of his accusers mother.<br />

More information has come to light  which may cast further doubt over the  charges filed against Jackson,  indicating the mother had previously  used a similar method for financial  gain. However, prosecutors have  repeatedly denied the family is after  money.<br />
<br />
During a pre-trial hearing yesterday,  Judge Rodney Melville granted a defense  request to subpoena psychological,  financial, medical and military records  relating to the accusers family. <br />
<br />
The judge also denied a defense request  to conduct psychological examinations  of the family. Senior Deputy District  Attorney Ron Zonen objected to the  widening scope of defense subpoenas,  labeling these as "undue invasion of  privacy, confidentiality and  privilege." <br />
<br />
Judge Melville, however, said that the  prosecution did not represent the  family and could not ask that any  documents remained confidential.<br />
<br />
The documents sought by Mr. Jackson are  believed to include psychiatric reports  from a civil suit previously filed by  the accusers mother - against retailer  J.C. Penney.<br />
<br />
The suit was filed after her son was  detained for allegedly shoplifting in  1998. Following charges being laid  against her son, she filed a $3 million  countersuit, claiming a security guard  at the store attacked her and her  children and also sexually molested  her. The company dropped the  shoplifting charges and paid the family  $137,000.<br />
<br />
The psychiatric reports in question,  now obtained by a number of news  organizations, were compiled in 2001 by  Dr. John Hochman, an assistant clinical  professor in the Department of  Psychiatry and Neurology at UCLA. <br />
<br />
The reports describe the mother as  delusional and draw the conclusion that  she may have fabricated the allegations  of abuse. Dr. Hochman, quoting the  mother, said that following the J.C.  Penney incident she saw a gynecologist  due to irregularities in her  menstruating and she was this way  because her body was traumatized and  ´every hormone in her body was being  released.´ There is no evidence  confirming [the mother´s] testimony she  had to get her hormones straightened  out due to the mall episode."<br />
<br />
Amongst other records, the defense has  requested gynecological records,  thought to be from this incident. An  attorney for the family filed an  objection to the release of medical  records. It is not clear if these are  the records referred to.<br />
<br />
Following the J.C. Penney incident, the  family complained of headaches and  nightmares. The children were scared  that "the bad people from J.C.  Penneys would hurt them, said Dr.  Hochman.<br />
<br />
He also noted that the mother  frequently claimed memory loss about  her life prior to the incident. "She  said she didn´t want to remember  anything about her prior psychiatric  treatment. She didn´t remember where  (her son) took dancing lessons.<br />
<br />
Dr. Hochman also reported "she was far  more upset talking about the mall  episode than about her son´s bout with  cancer. Her general demeanor alternated  between a blunted state and tearful  hysteria."<br />
<br />
The boy also indicated that the  incident was more frightening than  his battle with cancer, while his  brother described it as worse.<br />
<br />
The doctor stated that he thought the  interviews with the children were  rehearsed and pointed out "doubtful  aspects" of their testimony, saying it  was impossible for the whole family  to have "identical stories years  later."<br />
<br />
Following the incident, police and a  doctor stated that they saw no injuries  and were not told of any sexual  molestation - those charges were added  two years later.<br />
<br />
Dr. Hochman said the mother insisted  that "prior to the mall incident she  was living an ideal and extraordinarily  virtuous life,"<br />
<br />
The grand jury process is also expected  to suffer an attack from Jacksons  defense team who have claimed the  proceedings were flawed and biased. <br />
<br />
Granting a defense request, Judge  Melville ordered that transcripts of  the grand jury selection process as  well as written communication between  grand jurors and prosecutors be handed  to the defense. <br />
<br />
Also subpoenaed were materials used by  the county jury commissioner to select  the jurors. The jury selection process  is currently under review by the  California Supreme Court. <br />

The release of redacted documents, on  November 12, 2004, that are among the  evidence in the child molestation case  against Michael Jackson could collapse  the case, or at the very least, cast  serious doubt on the conspiracy charges  against him. The documents include  correspondence between then Jackson  attorney Mark Geragos and William  Dickerman, attorney for "Jane Doe," the  mother of Jackson´s accuser. The  letters were sent immediately following  the period during which Ms. Doe said  she was imprisoned by Jackson employees  and was fearful for her life. However,  the letters are very mundane, if  combative, and concern the return of  household belongings. There is no  mention of events remotely resembling  the accusations made in the Grand Jury  indictment. <br />
<br />
The letters reveal a prolonged and  acrimonious exchange between the  attorneys, beginning on March 26 and  ending on May 17, 2003. The letters  concern return of items that had been  removed from Ms. Doe´s home and placed  in storage. In the letters, there is  squabbling about when and where to  deliver the belongings, and concern  about who would make payments on a  storage facility. And yet, this  exchange occurs immediately after the  period that Ms. Doe claims she and her  children were falsely imprisoned by  Jackson´s staff. The question here is  simple. If Ms. Doe thought she and her  children had been imprisoned and her  life threatened, as she later claimed,  why did she not tell Dickerman, her  attorney? Kidnapping is a much more  serious issue than who will pay for the  storage of furniture. <br />
<br />
Ms. Doe´s accusations against Jackson  are similar to charges she made against  her now-ex husband in a divorce  dispute. About the Jackson case, Ms.  Doe said in a police interview leaked  to the media in September, 2004, that  she felt that "Somebody was going to  kill the kids and me. Mostly the kids."  In the divorce dispute, she accused her  husband of molesting their daughter,  kidnapping, and threatening her life.  In judge´s chambers, the daughter  recanted statements she had made  earlier, and said that the father did  not make death threats. Russell  Halpern, attorney for the boy´s father,  said that he believes the mother  scripted her children. Halpern said the  father once showed him a script his  wife had allegedly written for their  children to use when they were  questioned in a civil deposition. "She  wrote out all their testimony. I  actually saw the script. I remember my  client showing me, bringing the  paperwork to me."<br />
<br />
The charges against Michael Jackson are  not the first time Ms.Doe has leveled  charges of sexual abuse against  someone. It is the third. In addition  to the charges made against her  husband, Ms. Doe also accused security  guards of sexually abusing her by  fondling her breasts and crotch in a  parking lot. The guards had followed  her son and husband from the store and  accused them of shoplifting. The boy  reportedly was carrying a stack of  unpaid-for clothing. Ms. Doe alleged  that the abuse went on for seven  minutes, as her family apparently  looked on helplessly. As in the Jackson  case, there was a memory delay before  accusations were made. Ms. Doe  remembered two years after the parking  lot incident that she had been  (allegedly) sexually abused; these  accusations were added to her three  million dollar civil case against J.C.  Penney. <br />
<br />
Tom Griffen, Penney´s attorney, said in  an interview by Mike Taibbi on the  Abrams Report, March 4, 2004,"It became  readily apparent that this was an  incident, in my opinion, a scam to  extract money from J. C. Penney." The  case was settled out of court, for a  reported $137,000. According to  Griffen, the settlement was to avoid  the risk of losing in a jury trial. One  also assumes that the negative  publicity would not have been desirable  for the company. The psychiatrist  retained by Penney to examine Ms. Doe  said that he felt she scripted her  children´s stories to match hers.<br />
<br />
Veracity seems to be a serious problem  with this family. In the first  indictment Jackson was charged with  seven counts of child molestation. In  the second indictment, by a grand jury  presided over by Santa Barbara  prosecutor Tom Sneddon, the instances  of molestation had declined from seven  to three, with one alleged molestation  attempt. Where did the other three  molestations go?  Did the boy in  question, now a mature teenager,  testify to seven instances of  molestation and then remember that  three of them did not happen? Or, now  that he is older and wiser, is he less  cooperative? Inexplicably, the grand  jury indictment added charges not  present in the first indictment. In a report from the AP discussing what  was brought out in court today,  Jackson's lawyers revealed that civil  attorney Larry Feldman essentially lied  to grand jurors about the prospects of  the accusing family.<br />
<br />
They say Feldman told grand jurors,  after being called by prosecutors to  testify, that if the family pressed  forward with a criminal case it  diminished their chances of winning a  civil suit. This, of course, is a  complete lie. If they push ahead with  the criminal case to convict Jackson,  it all but ensures that they'll  received a civil judgement at the end  of it. That is, if they lie well enough  on the stand.<br />

    Jackson's lawyer, Thomas Mesereau  Jr., had presented a final exhortation  in favor of removing Sneddon, saying  that the district attorney and his  office had spent more money pursuing  Jackson than they had on the cases of  serial killers, showing that they had  lost perspective.<br />

    Mesereau said that Sneddon was so  personally invested in pursuing  Jackson's case that he misrepresented  to grand jurors the potential  motivation of a boy's family in  accusing Jackson.<br />
<br />
    Mesereau said that Sneddon brought  an attorney, Larry Feldman, before the  grand jury and had him tell the  panelists that a criminal prosecution  of Jackson would diminish the chances  for the boy's family to win  compensation in a civil suit against  the pop singer.<br />
<br />
    In truth, Mesereau said, a criminal  conviction would mean that the family  would be more likely to win a financial  claim against Jackson.<br />
<br />
    "It goes without saying that if you  obtain a criminal conviction, that will  establish liability," Mesereau said.  "Every lawyer here knows that if Mr.  Jackson was convicted of these  allegations, the alleged victims could  walk into civil court and get a  judgment."<br />
<br />
    He also cited Sneddon's personal  role in investigating the Jackson case  as well as his performance at a press  conference announcing the singer's  arrest.<br />
<br />
    But he said the entire district  attorney's office was too zealous in  the grand jury proceedings.<br />
<br />
    "They are too emotionally invested  in getting a case against the  celebrity.... They are blinded by zeal,  blinded by emotion in deciding how to  decide this case."<br />

    The judge expressed interest in one  point raised by Mesereau that Sneddon  might have to be a witness in the trial  because of his personal role in  investigating Jackson. <br />

Then out comes this gem of an  admission: Defendant does not have a  constitutional right to a District  Attorney who likes him, nor one who is  indifferent about prosecuting him  successfully (pg 10).<br />
<br />
I highly doubt Jackson gives a flying  flip about whether or not Sneddon  likes him. That is not the issue. The  issue is that Jackson IS entitled to a  prosecutor who looks at evidence, or  lack thereof, and takes into account  EVERYTHING; not just the information he  likes.<br />
<br />
Jackson IS entitled to a prosecutor who  furthers a case based on evidence,  not based on his sheer desire for a  conviction so much so that they keep  fishing100+ search warrants and  allhoping to find somethinganything.<br />
<br />
Jackson IS entitled to a prosecutor(s)  that doesnt break attorney-client  privilege or tramples on the rights of  the accused. It is his right, whether  prosecutors like it or not, to have a  prosecutor who isnt involved in  massive misconduct during the grand  jury process.<br />
<br />
Jackson IS entitled to a prosecutor(s)  who isnt a witness in this case, who  has not injected himself into this  case by an insane desire to convict  himnot matter what.<br />
<br />
It IS his right to a prosecutor(s) who  isnt trying to railroad him or convict  him in the court of public opinion with  the help of the DAs crisis management  firm.<br />
<br />
Jackson IS entitled to have a  prosecutor(s) who follow the freakin  law, whether is hurts their case or  not. Period.<br />
<br />
But these prosecutors seem to be  assuming Jackson wants someone to play  tiddlywinks with him in the courtroom.  Please.<br />
<br />
It is disgustingly ridiculous to claim  that the reason the defense wants  Sneddon & co. yanked from prosecuting  the case is because Jackson wants  someone who likes him. But then  again, some arent surprised by these  types of arguments from prosecutors  which seem more based on Ms.  Cleo-like speculation than on real  facts.<br />
<br />
The audacity with which they claim to  have had substantial evidence during  the 1993 investigation, yet brought no  case against Jackson is eye-rolling to  say the least. Now they claim to have  substantial evidence in this case,  yet cant seem to logically explain how  the accusing family vindicated Jackson  repeatedly while not at Neverland and  without one Jackson employee in sight.<br />
<br />
In fact, some observers speculate that  the only thing that held these people  hostage was Jacksons open-tab: the  credit cards, shopping sprees, free  trips, etc., etc., etc.<br />
<br />
Maybe prosecutors think they shouldnt  be held hostage to the lawor the  truthor the factsor the evidenceor  thewell you get the picture.<br />

Just when you thought prosecutors in  the Michael Jackson case may be  starting to get some sense about the  massive inconsistencies in their story,  they file a motion like their reply to  the defenses motion to have them  tossed from prosecuting Jackson. If  anything, the Plaintiffs Opposition to  Motion to Recuse the District Attorney  is more proof of why they should be  yanked.<br />
<br />
Tom Sneddon, the current DA of Santa  Barbara, has already become a witness  in this case. He will probably be  made to testify at a possible trial as  well; as he has already been made to  testify at a pre-trial hearing. That  alone, and the behavior which created  the situation, should be reason enough  to have him and his office tossed.<br />
<br />
Even in the face of this devastating  fact, prosecutors had the gall to claim  that the defense cant point to a  factual circumstance extrinsic to the  prosecutor which concerns a conflict  of interest. Better be careful what  they wish for because Sneddons past  may come back to haunt this case.  Some say they believe that there may be  extrinsic attitudes and behavior that  would cast a shadow on this  prosecution. But let me say it again:  the freakin DA is a witness in the  case. It shouldnt get past that  fact.<br />
<br />
For those who think DAs never get  recused, Sneddons office was just  yanked from prosecuting the case  against Judge Diana Hall last month  (September 2004) for a conflict of  interest (see DA Recused, Hall to  Testify in Dunlap Misconduct Case and  State decides to prosecute Judge Hall  ). <br />
