I will never step foot inside another hobby lobby for as long as I live.

I'm tired of their inconsistency with their art supplies... they'll carry a product ONE TIME then they'll NEVER have that same product again, or they'll have some other brand that is inferior to the original product. I have asked numerous times, if they can't keep a constancy with their art supplies allow the customers to special order, and they refuse to even do that.

I went in there looking for watercolor board... nothing... not even illustration board. I had to ask and the girl I spoke with looked at me like I was speaking to her in a foreign language. To top it all off, I tried to return something I only bought a month (or so) ago... and they tried to tell me it was 3 years old... I said no that's not right I bought it at the most a month and half ago... Granted I couldn't find the receipt, but to say it's 3 years old is just crazy, I even pointed out that it was marked cheaper than the others when I bought it. The manager took it back to compare it with the others and said what I had already told him, but refused to let me return it. So I told him "Fine, I will never shop in another Hobby Lobby" and left.

What really makes me mad about Hobby Lobby is that they choked out the ONLY REAL ART STORE in my area. So, Screw you Hobby Lobby... from now on I'll be ordering ALL of my supplies from Dick Blick.com.

If you've had similar problems, don't shop there anymore because to continue shopping there is only telling them that it's ok for them to continue providing substandard products and service.

This is more for my benefit than anything... seems to help if I write down my thoughts on what I'm doing and maybe get some input on what my artist friends think as well...

- - - - - - - -

Watching that video on Don Dos Santos yesterday did wonders for my muse... it was just the kick in the pants that I needed.

I've decided to pick this one back up and try to either start over, or work out the bumps in the road on the original...

The background as you can see is very dark... I know I didn't think on my colors long enough and started painting it without any real idea of what I wanted to do. I originally painted it yellow ochre with shades of alizarin crimson, then realized that it was going to be too similar to Kirana. At this point my only choice was to make the background darker, so I chose paynes gray with lots of salt, as of now I'm really unsure if I like how it turned out... yeah it has a lot of interesting texture, but it also has a ton of salt residue that I can't even scrub off. To me it seems too dark because there are going to be lots of dark colors, her hair will be black, along with her wings... the mask will be red/black and gold, her dress will be black/red gold... and of course the white skin. I could always slightly lighten the area around the figure with either acrylics or gouache... just so it pops a bit from the background...

Then... there's the second one I started, I decided to go a little larger to fill up more of the white space, now I'm not so sure I like it larger. >.<

maybe I'll just stare at it a bit longer to see if something hits me.

.:*~*:._.:*~*:..:*~*:._.:*~*:..:*~*:._.:*~*:.
Shoppe
[ Prints ] [ Commissions ] [ FAQ ]

"Art is the stored honey of the human soul, gathered on wings of misery and travail." ~Theodore Dreiser, Life, Art, and America, 1917

FROM THE ILLUSTRATORS PARTNERSHIP

The architects of the Orphan Works Act have already placed testaments to the bill on their websites:

Senator Leahy: [link]
Senator Hatch: [link]

They say this "landmark intellectual property bill" will "unlock proverbial attics of copyrighted works" whose owners can't be found. Is that really what all the fuss has been about?

No. If that were the case, the problems could be solved with a modest expansion of Fair Use. It's not proverbial closets we fear seeing unlocked. It's our commercial inventories, which would be exposed to potential infringement.

And while one Senator pointedly writes that the bill "does not dramatically restructure copyright law" (emphasis added), he's right: it doesn't "restructure" it. It merely redefines an orphaned work so broadly that it would let users infringe millions of works as orphans on the premise that some might be.

And why, if the bill is only meant to benefit libraries and museums, have the doors been opened wide for commercial usage?

A Fundamental Change to Copyright Law

For us, the saddest of these postings is on the Copyright Office website itself. [link] There, Marybeth Peters, the Register of Copyrights explains that this bill is necessary because the U.S., in trying to harmonize our law with international agreements, has created too many orphans.

But that's not the sad part. There are orphans. She's entitled to her belief. And as Register of Copyrights, she's entitled to lobby for a change in the law. But what's sad is that the Register, who we've respected for years as an advocate for creators rights, has chosen to justify this legislative scheme by mischaracterizing the honest objections that creators have raised in good faith, again and again.

Here's how she summarizes the objections of the hundreds of thousands of artists, writers, photographers and musicians who oppose this bill:

"Some critics [she writes] believe that the legislation is unfair because it will deprive copyright owners of injunctive relief, statutory damages, and actual damages. I do not agree."

Well, those are all real issues, but they've never been our focus. We've made our case clearly, simply and often.

Our objection goes to the heart of the matter. Here it is, as one of us expressed it in his opening statement at the Small Business Administration Roundtable, August 8:

"The bill's sponsors say it's merely a small adjustment to copyright law. In fact, its logic
reverses copyright law. It presumes that the public is entitled to use your work as a primary right and that it's your obligation to make your work available. If this bill passes, in the United States, copyright will no longer be the exclusive right of the copyright holder."
- From "Orphan Works: A Hobson's Choice for Artists," by Brad Holland August 8 2008

And in case the point needed elaboration:

"This exclusive right matters to artists for three reasons:
· Creative control: No one can change your work without your permission;
· Ownership: No one can use your work without your permission;
· Value: In the marketplace, your ability to sell exclusive rights to a client triples the value
of your work.
- [link]

The Orphan Works Act passed by the Senate Friday explicitly voids that exclusive right as expressed in Article 9 of the Berne Copyright Convention:

(1) Authors of literary and artistic works protected by this Convention shall have the exclusive right of authorizing the reproduction of these works, in any manner or form.

(2) It shall be a matter for legislation in the countries of the Union to permit the reproduction of such works in certain special cases, provided that such reproduction does not conflict with a normal exploitation of the work and does not unreasonably prejudice the legitimate interests of the author.

(3) Any sound or visual recording shall be considered as a reproduction for the purposes of this Convention.
[link]

There can be no responsible argument that the Orphan Works Act is consistent with Article 9 of Berne. None.

Simple reason: the Orphan Works Act does not limit exemptions to an author's exclusive right to "certain special cases." Case closed.

There are many other reasons to object to this terrible bill: it violates the entirety of Article 9. But we only need to make this single point to s...

Never Too Busy to Pass Special Interest Legislation

As lawmakers struggled Friday to clean up the mess on Wall Street, sponsors of the Orphan Works Act passed more special interest legislation. Their bill would force copyright holders to subsidize giant copyright databases run by giant internet firms.

Like the companies now needing billion dollar bailouts, these copyright registries - which would theoretically contain the entire copyright wealth of the US - would presumably be "too big to fail." Yet it's our wealth, not theirs, the scheme would risk.

Small business owners didn't ask for this legislation. We don't want it and we don't need it. Our opposition numbers have been growing daily. So Friday, the bill's sponsors reached for the hotline.

What is Hotlining?

Critics of hotlining say "that lawmakers are essentially signing off on legislation neither they nor their staff have ever read."

"In order for a bill to be hotlined, the Senate Majority Leader and Minority Leader must agree to pass it by unanimous consent, without a roll-call vote. The two leaders then inform Members of this agreement using special hotlines installed in each office and give Members a specified amount of time to object - in some cases as little as 15 minutes. If no objection is registered, the bill is passed."
- Roll Call, Sept 17, 2007

In other words, a Senate bill can pass by "unanimous consent" even if some Senators don't know about it.

The Devil's Own Day

Senators Leahy and Hatch hotlined the Orphan Works Act twice last summer. Each time came at the end of a day, at the end of a week, near the end of a legislative session. Each time lawmakers were distracted by other issues and other plans. Each time artists rallied quickly and each time a Senator put a hold on the bill.

Friday the Senators found a new opportunity.

With lawmakers struggling to package a 700 billion dollar bailout to avert a worldwide economic meltdown, with the rest of the country focused on Presidential debates, with Washington in chaos and Congressional phone lines jammed, they hotlined an amended bill. On short notice, even the legislative aides we could reach by phone said they didn't have time to read it. And so, while we were rushing to get out a second email blast to artists, the bill passed by "unanimous consent" - in other words, by default.

What better way to pass a bill that was drafted in secret than to pass it while nobody's looking?

Since Friday, artists have been conducting bitter post mortems on their blogs. That's understandable, but it's not time yet.

"When Sherman arrived at Grant's headquarters later that evening, he found the general - broken sword and all - chewing on a soggy cigar in the rain, which had begun soaking the battlefield.

'Well, Grant,' Sherman said to his friend, 'we've had the devil's own day, haven't we?'

'Yes,' replied Grant, 'lick 'em tomorrow, though.'"

The Senate passed their bill Friday, but the House hasn't. There's still time to write, phone and fax your congressional representatives. Tell them not to let the House Judiciary Committee fold their bill and adopt the Senate's.

Tell Congress to protect the private property of small businesses. Lick 'em tomorrow.

- Brad Holland and Cynthia Turner, for the Board of the Illustrators' Partnership
Quote from "The Devil's Own Day," by Christopher Allen, January 2000 America's Civil War Magazine

TAKE ACTION: EMAIL CONGRESS TONIGHT
Tell the House Judiciary Committee not to adopt the Senate version.

We've supplied a special letter for this purpose: [link]

Please post or forward this message immediately to any interested party.

<img src="ht...

Yeah Yeah... I know... what can I say, it doesn't matter how much I loathe feebay, it still stands that it's the most active market out of all of the auction sites I've tried in the last few months.

I was really hoping that my etsy store would have taken off since I gave out nearly 300+ business cards at Origins alone. But it hasn't. So I decided (a quote from my friend ) "I opened my vein and let ebay drink." Gruesome but sometimes that's how I feel especially with the now 8.75% final fees and if your item sells for more than 25.00 tack on an extra 3.50%.

FeeBay is a greedy blood drinking monster.

So, I present to you... my FeeBay Store.

<img src="http://home.comcast.net/~fi-files3/dalinks/cp-da-quote.jpg" alt="Every artist dips his brush in his own soul, and paints his own nature into his pictures. ~HW. The ones I'm talking about... the ones that are devoid of any those elements, the close up shots of body parts, genitals or people making out. I know 'art is subjective', but come on people, just because it gets you horney or makes you 'hot' doesn't make it 'art' it's a selling point that's all.

>> too many people don't write about their work. "..." is not acceptable. Try that with a real gallery or real art show and you'd be disqualified so fast it'd make your head spin. With that, if it's a DD and they don't write about the piece, I won't even leave comment on it or add it to my favorites. IF they can't take a few seconds to write about it, that shows me that they don't really care about the work they do or care about their audience. Writing about your work is meant give the viewer insight as to what you were thinking, or how you were inspired, it's about bringing the viewer closer to the art or to make a connection with the artist.

feel free to add your own.

<img src="http://home.comcast.net/~fi-files3/dalinks/cp-da-quote.jpg" alt="Every artist dips his brush in his own soul, and paints his own nature into his pictures. ~HW. Being hidden in the curtains, and placed throughout the show was just horrible. There was a drastic increase in foot traffic. Had tons of fun, talked to many MANY people. Mostly we hung out with Art & Jimmy (since they are our home town homies). Because this show was far better than the last two shows, I will be attending next year. But... if next year sucks, the following year I'll be joining Nigel at Acen!

Friday was a super awesome day, sold lots (Friday's are almost NEVER that busy), I was soooo tired and giggly, I was running on Red Bull & Revive Vitamin Water. After dinner, Art was trying to get us to go see Iron Man, I refused because I knew just as soon as the lights dimmed I'd be dead asleep.

Saturday morning came around all too soon, but we were up and out the door, ate breakfast at a diner called Rosewood. (They have an AWESOME Breakfast Menu). Once they let people into the show I was super busy! O_O it was fun, there wasn't a dull moment. My husband went and got me Billy Dee's autograph, which completes the Empire Strikes Back picture I had started a few years ago. Just after he got it some guy in line offered him 250.00 for the pic.

We went to dinner at the usual Mongolian BBQ, it was Art, Jimmy, Nigel, Marie, Ken (Radioactive Man & Futurama Comics) Wheaton, Jimmy (Zombie Bob gets a Job) Proctor, Mike Bocianowski, Pat & Myself. After dinner Nigel & Marie went to the party, while the rest of us found a theater and saw IRON MAN. O_O OMG it was an awesome movie. I've never been a big fan of Robert Downey Jr. but Hell he was fantastic! A few weeks ago (maybe even a month ago) I had read a really interesting article on him, I was impressed with his outlook and his ability to laugh at his past. I believe this could be a major step for him, I hope he stays sober because he was brilliant.

Sunday was kinda slow, as are most Sundays. But none the less it was lots of fun, that's when I get out to see the show.

So many awesome people stopped by, talked briefly to Katie and Andy Price, I also talked to Greg and Eric from The Pullbox. . I bought some prints from Mike. I made it over to take pictures of the Monkee's car and bought myself one of [ these ] but a small one that goes on my bookbag.

PICTURES!

<a href="...

FROM THE ILLUSTRATORS’ PARTNERSHIP

Some backers of the controversial Orphan Works bill say they’re launching a campaign to “Rescue Orphan Works.”

From whom?

We’re not the ones interested in infringing other people’s copyrights.
We’re only interested in protecting our own.
If the “Rescue Orphan Works” folks really want to use only true orphaned work, they’d join us in asking that this bill be drafted accordingly.
From our written statement submitted to the Senate April 30, 2008 [link]

We believe the orphan works problem can be and should be solved with carefully crafted, specific limited exemptions.

• An exemption could be tailored to solve family photo restoration and reproduction issues.

• Usage for genealogy research is probably already covered by fair use, but could rate an exemption if deemed necessary.

• Limited exemptions could be designed for documentary filmmakers.

• Libraries and archives already have generous exemptions for their missions. However, if they believe they need expanded access to work whose authors are hard to find, we’d suggest that Congress adopt a variant of the Orphan Works clearance system in use in Canada.

Canada has created a statutory licensing scheme that allows licenses for the use of published works to be issued by the Copyright Board of Canada on behalf of unlocatable copyright owners.

The license is issued by the Canadian Copyright Board. Decisions are made on a case-by- case basis through application to the Board. If the Board is satisfied by the applicant’s efforts of e-mails, phone calls, written correspondence, approaches to copyright collectives, Internet searches, etc., then it may issue a non-exclusive license which is valid only in Canada, subject to any terms and conditions it sees fit.
[link]

A system such as this would serve potential users of orphaned work by allowing them to clear rights in an orderly, verified way. Therefore we respectfully ask that the Senate conduct further hearings to resolve the specific problem of providing public access to true orphaned works. Our objections to S.2913 – which incorporates the proposals made by the Copyright Office – is that its effects cannot be limited to old or abandoned copyrights.

There’s no need to “rescue orphan works” from artists.
And you don’t save orphans by making new ones!

Help solve the real orphan works problem: Don't Let Congress Orphan Your Work

2 minutes is all it takes to write Congress and protect your copyright: [link]

Please forward this message to every artist you know.

<img src="http://home.comcast.net/~fi-files3/dalinks/cp-da-quote.jpg" alt="Every artist dips his brush in his own soul, and paints his own nature into his pictures. ~HW.
I can't believe so many artists are willing to just sit and wait for this to pass before they take a stand against it.

People, if these current versions pass, it will be devastating.

Just to show you how the US Government likes to &#039lay' with words... read on.
----------------------------------------------------------------------------
FROM THE ILLUSTRATORS’ PARTNERSHIP

Backers of the Orphan Works bill are circulating their Talking Points:

“Neither the House nor the Senate drafts of the bill contain the word “registries,” [they write] but rather they require users to search non-governmental databases of copyrighted works. The purpose of any database is not meant to take the place of copyright registration, but to have a way to search for visual images. Any participation in such a database would be voluntary.”

But this doesn’t mean what it appears to say. Take it point by point:

Talking Point #1: “Neither the House nor the Senate drafts of the bill contain the word ‘registries.’ ”
Response: Correct. They contain the word “databases,” a synonym:

Registry: register: an official written record of names or events or transactions
[link]

Database: A database is a structured collection of records or data
[link]

Q: Why a synonym?
A: Because international copyright law forbids member countries to impose registries as a condition of protecting copyrights: Berne/Article 5(2) ”The enjoyment and the exercise of these rights shall not be subject to any formality.” [link]

In other words, if they used the word “registries” in the bills, it would be a red flag to other countries that the US is flirting with non-compliance with international treaties.

Talking Point #2: “...rather they [the bills] require users to search non-governmental databases of copyrighted works.” Response: Non-governmental databases” means databases maintained in the private sector.
For users to find your work in these commercial databases, your work would first have to be in the database.
Work not in the database would be orphaned.

Talking Point #3: “Any participation in such a database would be voluntary.”
Response: Congress cannot pass a bill making registration mandatory because that would violate Berne/Article 5(2).
And that would state explicitly to other countries that the US no longer intends to honor its international agreements.
There are red flags all over these talking points.

Summing up: The Orphan Work bills would mandate the creation of registries by commercial interests.
You would not be legally forced to place your work with these for-profit registries.
But failure to do so would orphan your work.

The deceptive talking points accompanying this bill are another red flag.

— Brad Holland and Cynthia Turner, for the Board of the Illustrators’ Partnership

Take Action/ Write Congress [link]

Over 37,000 messages have been sent from the site in the last 48 hours.
egads, I didn't realize it's been two weeks since I updated here....

lets see... about a week ago my pc died for real... it won't boot or anything... and since the HDD where all of my work is (yes I have two Hard Drives), is nearly full, and instead of just upgrading my current pc, because I really think there's a short in the tower) I thought that I'd spend the money on an XPS 630 from dell... It should be here between the 25th -28th. *crosses fingers* I can't wait for it to get in so I can get back to normal. I have artwork to scan and I really need to update my website.

I've been using my old p2 gateway to hold me over and to keep up on email... it takes forever to boot up, and just about as long to load any websites. Certain sites I can't even go to, like my comcast email, because that site is so media rich my browser freezes.

I have a painting started, you can see the line work [ here ] I also have a bunch of little faeries drawn that I need to enlarge so I can paint them as well.

With my utter lack of gaming I've been keeping uber busy. Tho I do miss playing my little Troll Shaman.

oh and on that photobucket thing, they have YET to remove my artwork from that persons gallery, even after I filled out their removal form, which it's now going on two months.

Once we receive all the information required by DMCA regulations, we will remove the images in a timely manner.

What is their idea of 'timely manner'? 6 months? 8 months? a year? I've canceled my photobucket account because I loathe the idea that someone can make money on the images they've stolen from me, or any other artist for that matter. That place just makes me soooo mad. bah.

Just a reminder, if you want to get in touch with me, or would like to commission me, please contact me at: cpersampieri (at) gmail (dot) com.

<img src="http://home.comcast.net/~fi-files3/dalinks/cp-da-quote.jpg" alt="Every artist dips his brush in his own soul, and paints his own nature into his pictures. ~HW.
Well... it seems that comcast has finally fixed what ever their problem was after their big server upgrade, that broke my website.

Tho, before I change the message on the front page, or do any updates; I'm going to keep an eye on it this week to see if it mysteriously breaks again. For a while I was considering dumping my site and having my domain point to my deviantArt gallery.

On other news front, we sent in our submission for the Geneseo Music & Craft Festival... this is the first time it's a juried show, I'm sure I'll get in with no problems, but I still get nervous. Also I'm glad that it's NOT on the same weekend as Origins, which I need to send off my payment.

I have a few cards up on Feebay, but I'm thinking they are going to be my last for a while. Tho, I will be adding many wonderful things to my etsy shop by the end of the month. (I'm anticipating a new pc soon, so setting it up is going to take a good chunk of my time)

Oh yeah... if you're on Facebook... I now have a 'Page'.

That's all for now... I'm really puzzled over this, because everything was working fine before their upgrade... and afterwards... it doesn't work for IE. go figure.

so... I put a blurb on the front page, telling internet explorer users to come here to view my artwork.

Also these are works I had up on my old account that I just never got around to adding after moving.

<img src="http://home.comcast.net/~fi-files3/dalinks/cp-da-quote.jpg" alt="Every artist dips his brush in his own soul, and paints his own nature into his pictures. ~HW.
Sorry for the complete lack of updates... I've been so uber busy, I can't even shake a pointed stick at it. O_o (rather be too busy than not busy at all... ya know?)

So... Wizard World was so much fun, by far - much better than last year! Next up is GenCon, the largest show I do to date. ^__^ So much to do in such a short amount of time.

Other News
Sketch Cards... I finally finished those 450 Sketch Cards for the Shaw Family Archive Marilyn Monroe Collection on Monday and sent them off, I'm now working on 106 cards for the Topps Heroes Set and 25 for CSI NY, both due the end of the month.

My very first official guest appearance will be in October at The Chicago Non-Sports Expo. --> [link]

It has been brought to my attention, even after specifying in the description of my images that I don't allow my artwork to be used for Tubing, Tagging, Sigs or Incredimail layouts, people are/were still snagging my work and doing just that.

Recently a logo I had created for my friends business was snagged and tubed and distrubuted without my permission.

So...
This is just a reminder I don't allow my artwork to be used for these purposes.

Please read this, if you still don't understand, then you can email me, and don't be snarky when I still say no.

FIRST AND FOREMOST: For personal & professional reasons, I will not allow or grant permissions to anyone to use my artwork for Tubes, Tags, Signature Images or Incredimail layouts.

Why?
Because in 2004 my entire gallery was ripped off, tubed, and redistributed without my permission, my print sales went to ZERO because of it.

Important Copyright Information:
TITLE 17 > CHAPTER 1 > § 106A [link]
Ask First [link]
rightsforartists.com [link]
copyright.gov [link]
whatiscopyright.org [link]
give-credit.com [link]

Prints & Originals
I retain all rights to my work whether it's prints or sold originals. When purchased, the buyer has not purchased; the character, copyrights, reproduction rights, nor the right to display this piece in a gallery, in print, or on a web site (either by itself or as part of a collection) without the artists prior permission or proper compensation.

Web Sites:
I've had many requests from people wishing to use my artwork to decorate their web site or their discussion group (yahoo groups or msn groups). I'm inclined to say no. If I find my artwork being displayed in this manner without my permission, I will contact you and ask you to kindly remove it (this includes any icons I find stolen from my journal). My last resort will be to contact the ISP, or whom ever is hosting where ever it is being displayed at, and tell them that your site/discussion group is is hosting stolen artwork.

Tubing & Tagging:
I will not grant permission to anyone seeking to use my artwork for tubing, tagging, signature images, and stationary. I put a lot of time and effort into my works, and I feel disrespected when I find that someone has taken it upon themselves to deface or alter my vision and hard work. There are many other artists on the web that allow their artwork to be used for this I am not one of them.

My Work as your Tattoo:
Being that I've been rippped off so severely in the past, I will not provide electronic version of my original sketches or original artwork for tattoos. If you'd like to purchase a Limted Use License, please email me at cpersampieri@gmail.com. The cost is 50.00, as part of the agreement, you will get a certificate that will grant your tattoo artist permission to reproduce my work on your skin and a 8.5x11in. high quality print mailed to you. (shipping: us is 4.00 & international is 7.00)

.:*~*:._.:*~*:..:*~*:._.:*~*:..:*~*:._.:*~*:.
Shoppe
[ Prints ] [ Commissions ] [ FAQ ]

"Art is the stored honey of the human soul, gathered on wings of misery and travail." ~Theodore Dreiser, Life, Art, and America, 1917
