Notice: My computer hiccups once or twice and signs me out of USTREAM (cat+broadcast) for about 3-7ish seconds when it does, it fixes itself don't panic.

On top of this-until I find the elusive second cable modem-I am streaming through a cruddy Linksys router, it may disconnect me from the NET for just a minute. There's really nothing I can do to fix these two issues till I get the other modem that I found and got re-lost from husband's parent's apartment, and after we re-find it I am HOPING it fixes the first issue too-as it sounds like a router speed issue to everyone. My ISP speed has nothing to do it, it's many times the suggested up/down. *nods*

The Article

I need your help. My original art has been copied by a manufacturer who is now suing me in federal court to overturn my existing copyrights and continue making knockoffs. I have a strong case, a great lawyer and believe that if I can continue to defend myself, the case will be resolved in my favor. If I run out of funds before we reach trial, a default judgment would be issued against me and could put me out of business. I don't believe my opponent can win this case in court and I don't believe he really intends to try. I believe his goal is to use strong-arm litigation tactics to force me to keep spending money or risk losing my copyrights Â not by true adjudication, but by default if he is able to outspend me.

There's a lot of information in this post because it is a complicated story. If you care about the arts, or work as a creative professional, I hope you will read it and send this post to anyone you think can help.

I did not initiate this lawsuit, but am defending my art, my creative rights, my reputation and my livelihood against attack. I've already spent over $50,000 out of pocket in defense of my original designs.

Seeking a judicial ruling in federal court will cost more than any artist or small business can afford on it's own, but attempts at settlement have been unsuccessful. I am holding a fundraising sale of my artwork to finance a defense in court. If you can contribute to the fund or share this story with others to help raise awareness, it would mean the world to me.

Imitator Sues Artist to Overturn Copyright on Sculptural Art
FirePitArt.com, LLC and owner Rick Wittrig have filed suit against me in federal court seeking to overturn my formally registered copyrights in order to continue selling unlicensed knockoffs of my work. He argues that my original Artisanal Firebowls are not properly classified as sculptural artwork, despite the fact that Wittrig sells his copies at art fairs, describes himself publicly as an artist, and even uses the word art in the name of his business. When Wittrig first launched his website he offered only six designs of firepits all of which bear an uncanny resemblance to my Artisanal Firebowl sculptures. One of these even initially bore the exact same name as my Waves O' Fire. He appears to be mass-producing these designs, and is selling them at discounted prices on several of the largest internet retail sites devoted to outdoor living. Prior to the launch of his website, I have been unable to find any documentation of Wittrig making any original art.

I have gained an international reputation for my Artisanal Firebowls, unique works of art hand-crafted from 100% recycled propane tanks which I have been creating since 2005. IÂve worked hard to build a reputation for honesty, quality work, customer service and approachability. I am concerned about people confusing my art with the work of another because I have no way of insuring that they experience the same quality, attention to detail, and integrity. When Wittrig began selling his firepits which so closely resemble my work, I began seeing instances of confusion over authorship almost immediately. An artist messaged me on Twitter, believing she had met me at a Tennessee art fair. Photos of Wittrig's firepits were posted to a blog and mistakenly attributed as my own. I got an email from a landscape architect I had discussed commissions with in the past. She wrote:

Being exhausted from lack of sleep & worrying about the grade, I just had some rice and took a nap.

Well, my phone started ringing, I answered it to find an awestruck voice on the other line-a school coordinator, and the guy who happened to be grading all the work everyone just did. Among the many other things he told me, both of my essays were pretty much the best essays he had seen in a while. We had a long conversation about how much he loved my work, which was the exact opposite I thought I would be told-beyond actually.

Instead of being bored by my work, like more or less all the essays were doing, my essays--short stories about each subject, exactly within the required writing length range--were so captivating and creative he really really read both and went "wow!". My story about my artwork and it's importance to me had also touched him deeply, seeing as how he had the same thing with his writing & people's opinions on it.

I've been given instructions to go see him when I go to get my diploma, so he can parade me around the school, apparently he's bragging about me.

These were the topics, maybe not exactly word for word, I did not write them down...

Topic A: Write about something you or someone else had hat was important, and why it was so important they never gave it up.

After facing so many bad times trying to socialize with (or avoid...) fellow students I dreaded going to yet another public school. I stated that I taped pictures of some of my interests on a clip-board and "displayed it" (carrying it in a way so that people could see and hopefully tag me) when I went to the office. I bumped into two girls Heather & 'Nikko'-how they grabbed me more or less right away after I started attending, as well as how those two I ran into as well as a third-Sonya-became a more or less inseparable quad. Other than explaining why I liked this friendship circle so much I said I could not really pinpoint many memories as I enjoyed the entire time, but I talked a small sentence or two about the field trip to Water World (Nikko no go go), as well as hanging around Nikko's sister (known here as =nashidesei) while she drew and worked on characters for an original comic series.

To be honest I was so surprised by the call it was also a good thing Sean (~Mathias-Wolfe) was in my face making stupid faces and being weird, it kept me focused more. Felt like I was going to faint, I was not expecting that call or that opinion!

I PASS WITH FLYING COLORS = WIN!

And as a result of this, I will start writing again. Possibly may show it off depending on things. The coordinator told me my writing shouldn't continue to go to waste, I should get back to it and not give it up-just like I don't give up on my art.

Some people may be rude about it, about liking my art AND writing or not, so I tell them to go away. This isn't about their opinion, its about MINE. Going back to school so I can move on to college also wasn't about others' desires for me to go or not, it was mine. I did it, I'm doing it, there!
