I'm coming home tomorrow, and staying until Wednesday morning at 5am.

I really don't know about my life right now. There's so much going on, that I absolutely love...but with each day going by, I identify less with my identity, if that makes sense.

I was depressed a couple days ago, but now the depression is gone. In fact, I'm excited. But I'm still feeling that same feeling of "this isn't my life, is it?"

I'll post a bit more when I become more coherent...

Soooo...Jaimee and I were driving along, and I rear ended a car at 40 miles an hour. The car skid out of control, and hit the SUV in front. We ended up on the grassy median.

We weren't hurt, other than my face getting hit by the airbag, and my watch cutting into my wrist (which the airbag hit, so it got fairly bruised. My car is probably totaled, but we'll see.

CS final in half an hour. Wish me luck.

I just saw Howl's Moving Castle. It's hard to describe...the story wasn't quite as engaging as Spirited Away, but the art was f'ing gorgeous. I was astounced. I was amazed. I have an unidentifiable urge to cosplay, and I really don't know why. But anyway.

And you haven't really seen a movie until you've seen it with 400 people your age. Everything that makes you snicker, you'll hear the entire audience snicker. Anything that makes you go "awww", you'll instantly hear it. This movie had more of each of those than I could count. And it was FUN. I'm definitely going to have to see Charlie and the Chocolate Factory and March of the Penguins when THEY come out.

Oh, and I made a Terragen world. I'll post it later, probably with my watchlist.

The title of this journal comes from a chat. Hehe.

Grrr. I'm still angry at DA. They banned me for 24 hours without warning, even though my question was valid. I guess I just didn't ask it at the right time, or something. They never answered my question, either. I'm not about to leave, but I think whoever mans the help desk should get their head out of their ass. (Or maybe just go over to the offices of all those responsible for firing °jark and they could start a heads-in-asses club.) Anyway, here's what I sent.

I have an inquiry to the ban of the user !samantharobinson.

Due to the misinformed actions of one of her enthusiastic fans, I'm sure you will be receiving a lot of these inquiries, in spite of FAQ #325: Will you tell me why my friend was banned?. My inquiry comes from a different position.

Which part of the etiquette policy allows a community member to be banned for noticing a submission policy violation, and how should one go about releasing evidence of such (whether or not a violation actually took place)? I understand that personal attacks on any particular deviant are not to be tolerated (per "Community Rules"). However, Samantha's qualm clearly took place against the artwork, not the artist, and she supports it as such. As this rule is not clearly noted in the Etiquette Policy, how should one discourage tracing/theft without being banned?

In other news, I got a raise. And I'm the webmaster of a DeCal site. And I got an 89 on the midterm that I thought I would suck at. But I'm also somewhat in the middle of a friend feud, which I hope will resolve itself soon. And I have pictures, by the way, but I need to get around to posting them.

how i'm feeling> I don't know if today is the best day of my life, but it's damn close. I found out that I absolutely DOMINATED the AP test I took on Wednesday, and the partner exam I took this morning. I watched The Handmaid's Tale for extra credit in English, I'm on top of everything in Yearbook (including an Access database and some Photoshop magic), I won badminton matches on Tuesday and Thursday, and played some of the best singles' in my life today at practice. Plus, there's dancing tonight, and I get to tour UC Berkeley tomorrow. Life is wonderful.

report card> 4.17 GPA. A's in Film, Yearbook, and Band. B's in English, Calculus, and History. Worst grades of my life. And I officially don't care. Rock on.

dancing> None for me this Friday. I'm going to Wynton Marsalis with the Lincoln Center Jazz Orchestra at the LBC. Don't ask me...my Dad bought the tickets...but it looks like it could be fun. computer crap> I just got pictures back, I have some digital camera pictures, and I'm starting to fill my sketchbook. And guess what? My computer died. The worst part about it? I'm stumped as to how to fix it. So, no posts for me for a while.

think you can help?>Apparently, there was a General Protection Fault with NTLDR. I ran Norton Disk Doctor, and it picked up on a NTFS Security Descriptor error...but even after I fixed that, it still GPF'd. So I reinstall Windows, and now it won't pick up on my ASUS P4PE mainboard's onboard USB and network card...so even if I could use the damn thing, I couldn't get onto the Internet. Apparently the Windows Management Instrumentation data's corrupted, and even after reinstalling the drivers I have no idea how to fix it. I am such a geek. I hope you are too.

So, apparently there's some trauma involving *weremagnus and ~saddentiger23 . From what it seems, ~saddentiger23 copied character designs *weremagnus created, including a character design she made for her friend ~neogeen.

DeviantART responded with FAQ #304: Someone has posted an image which looks just like mine, why won't you remove it? and [link] saying they really can't step in if art looks strikingly similar. I can't exactly blame them for taking this stance. After all, dA is supposed to be an all-inclusive place, rather than excluding artists who wish to emulate other artists.

Now, I'm not defending what ~ saddentiger23 did, I think she should have asked permission before emulating (imitating) the other art. However, DA is in no position to tell ~saddentiger23 to do, and is under a certain community obligation to protect its members from undue harassment, including flames.

DeviantART also claims that copyright laws only protect drawings, not characters. This is where DeviantART is wrong. According to [link] (click and search for California Raisins), characters and their likenesses can be copyrighted even if they are created from scratch. It's also worth mentioning that ANY PUBLISHED WORK is AUTOMATICALLY COPYRIGHTED. No need to file with the government or what not. Furthermore, CHARACTERS MAY BE PROTECTED UNDER TRADEMARK LAW, which again does not need to be registered with the government according to [link] (if you see an ®, it's registered, if you see a ™, it's not registered).

However, take a look from DeviantART's standpoint. Lawyers get paid huge sums of money for intellectual property cases, and DeviantART isn't in a position to judge. So DeviantART can officially respond to "art theft", but it cannot officially respond to "character theft." If you see "character theft," politely tell the person involved to remove the work or give you credit. And if they don't, you could potentially have a strong legal case. If you care that much.

Think about it. If you were to put your work in a public gallery, it's reasonable for the gallery owner to put a sign saying "please don't take pictures." It is inappropriate for you to insist that they hire a security guard to keep people there--that just doesn't make sense. So, DeviantART (which, by the way, is FREE) offers you hosting, and discourages art and character theft. But if you want to pursue this case, do it on your own. Don't blame DA.
